Hojuventure Travel TERMS AND CONDITIONS

1.1 Your travel has been booked by DL Gallon ABN 20487098048 trading as Hojuventure Travel ("us" or "we"), on the basis of the following terms and conditions.
1.2 Your travel voucher(s)/ tickets will be e-mailed to you separately, as soon as the booking(s) have been confirmed by our suppliers. This will usually happen within 24-48 hours.
1.3 The issued ticket(s)("voucher(s)") have been booked by us on your behalf with various Service Providers. Each Service Provider may have their own terms & conditions applying to your travel. It is important that you read the relevant & corresponding product page for each of your bookings in order to understand all applicable terms & conditions. If you require additional information to that contained on the product page then we recommend that you contact the Service Provider for further clarification.
1.4 We may change these terms and conditions from time-to-time. The updated terms and conditions will be posted on our website, with the date of the update shown.
GENERAL CONDITIONS
2.1 All prices and inclusions are subject to change without notice.
2.2 Travel insurance is NOT included in the cost of any product and it is highly recommended that you purchase your own.
2.3 To the extent permitted by law, all implied terms or warranties, whether statutory or otherwise, are excluded in relation to the services provided by us under these Terms and Conditions. The Australian Consumer Law provides consumers with a number of protections and Consumer Guarantees which cannot be excluded or limited (Consumer Guarantees). These terms and conditions are to be read subject to those Consumer Guarantees. Where there is a minor service failure, we may at our option, provide the services again or offer you a refund. Where there is a major service failure, you can elect either to cancel the services and obtain a refund or request a replacement service. Alternatively you can seek compensation for the value of the difference between the service provided and the service purchased. You are also entitled to compensation for any other reasonably foreseeable loss or damage arising from a major service failure. The Consumer Guarantees referred to do not apply to, and we do not accept liability for, service failures relating to the transport of goods for the purposes of a consumer’s business, trade, profession or occupation. Where our services are not acquired for personal, domestic or household purposes, we limit our liability for failure to comply with the Consumer Guarantees to supplying the services again or paying the costs of having the services supplied again.
BOOKING CONFIRMATIONS
Your responsibilities:
3.1 Open dated tickets: You must book your travel dates in advance with the individual Service Provider as per details provided on your ticket/ voucher. We recommend you book at least 14 days before.
3.2 Tickets with booked dates: It is your responsibility to ensure you redeem your tickets on the dates booked. If you wish to change these dates you must organise it with the Service Provider directly, with adequate notice.
3.3 You must reconfirm all booked dates 48 hours prior to travel (minimum guide only) or in the manner stated on your ticket/ voucher. If applicable, dietary requirements should also be confirmed at this time.
3.4 Your booking will not be processed until you have filled out all your details. You will be able to fill out your details after your payment.
CANCELLATIONS AND REFUNDS
4.1 Credit card fees and fees paid to us are not transferable or refundable.
4.2 If you cancel your travel, you must pay us a fee of 50% of the value of the travel that was booked on your behalf and cancelled ("Cancellation Fee"). In addition, if a Service Provider charges us for the cancelled travel you must also pay us the amount that we are charged on your behalf by the Service Provider.
4.3 It is therefore possible your cancellation fees could be up to 100% of the cost of the booking, regardless of whether travel has commenced (for example cancellations made within 24hrs of travel or certain bookings).
4.4 The Cancellation Fee will apply in all cases where a tour is able to run. For example, if you are unable to reach a tour due to an "act of God" (for example a road is cut off due to flooding) the normal Cancellation Fee will apply if the tour still runs in your absence or would have run but for your absence.
4.5 If a tour or other travel service is cancelled by the Service Provider, we will first endeavour to rebook you free of charge. If this is not possible, we will refund you the amount paid for the tour or other travel service, less a 10% administration fee ("Admin Fee").
4.6 This full refund minus admin fee is subject to a fully refundable amount being given to us from the supplier who is cancelling.
4.7 We highlight here that all suppliers have different cancellation terms, and are on a case by case basis. Please note that in the case of Natural Disasters (e.g. flood, fire, cyclone, etc) many service providers do not offer any refund, hence we cannot provide a refund to you. We strongly recommend Travel Insurance to cover this situation.
4.8 The 10% Admin Fee does not apply to: Dive Courses where you fail a Dive Medical test; or Skydives cancelled by the Service Provider within 3 days of booking due to weather, and a full refund will apply.
4.9 Whilst we normally attempt to process refunds swiftly, situations (such as natural disasters) may result in up to 30 days processing time, due to high volume.
4.10 By purchasing a cancellation insurance policy at the time of entry into these terms and conditions you can reduce all risk of being subject to various fees and unexpected costs as a result of unforeseen circumstances and changes. You in some cases can claim up to 100% of the associated costs/ fees incurred through the insurance provider, depending on the terms of policy purchased. Cancellation Fees can vary from 10% to 100% for bookings.
4.11 Tickets for theme parks, attractions, shows or coupons, as well as gift vouchers are non-refundable in all circumstances.
4.12 Any bookings commencing during a “special event period” are non-refundable in all circumstances. This includes, but is not limited to, trade fairs, public or national holidays, school holidays, New Year's, Christmas, Easter, Ramadan.
DEPOSITS
5.1 We will take deposits on a planned tour(s) and hold it for you for a period of 48 hours. Minimum deposit is 20% and this is not refundable should you choose not to proceed.
TRAVEL INSURANCE
6.1 We endorse the recommendation of the Department of Foreign Affairs and Trade that all travellers take out travel insurance. We can provide information to you about travel insurance should you require it. It is your personal responsibility to purchase your own travel insurance to cover any liability which may be incurred to us or a Service Provider and other travel misadventures that you wish to be insured against.
6.2 We recommend that you source travel insurance with a low excess payment, to make claiming on cancelled tours worthwhile.
SERVICE PROVIDERS
7.1 We endeavour to package tours that will meet your expectations. However, we take no responsibility for any matters that arise with regard to or during individual tours or arrangements with individual Service Providers.
7.2 We appreciate your feedback, whether complaints, compliments or suggestions. However, to the extent permitted by law we will not be responsible to you for any loss, expense or damage that you may suffer during any particular tour, accommodation or travel, no matter the cause. These matters are the responsibility of each individual Service Provider and you agree that you will not hold us liable in any such circumstance.
7.3 As a valued customer of Hojuventure Travel you may receive work and travel deals and exclusive notifications from Hojuventure Travel and brand affiliates.
PRICES
8.1 We endeavour to package the best value tours available at the best prices. However, we take no responsibility for price fluctuations arising from changes in the prices charged by Service Providers occurring before final payment. Accordingly, the price of your travel is subject to change until such time as you pay for the travel in full.
EXTRA COSTS
9.1 Many tours have extra costs and you should be aware that there may be added expenses. These expenses will differ for each Service Provider but some of the more usual extras are: EMC Tax, Stinger suit Hire, Luggage storage, Sleeping Bag Hire, Linen Hire, National Park Fee, Food, Insurance, Accommodation, Equipment Hire, Petrol Levy.
9.2 We will alert you to extra costs to the extent reasonably practicable. However, you must also check with each individual Service Provider when you confirm your ticket.
9.3 All ticket/voucher reissues may attract a $20 administration fee.
9.4 Transfers between tours may incur a $30 administration fee.
PASSPORT VISA AND IMMIGRATION
10.1 It is your responsibility to fulfil the passport, visa and other immigration requirements for all transiting and stopover destinations applicable to your itinerary. You should confirm these with the relevant high commissions, embassies and/ or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements. Your passport must be valid for 6 month beyond your return date.
TRAVEL ADVICE AND VACCINATIONS
11.1 Australian residents should refer to the travel advice posted by the department of Foreign Affairs at www.dfat.gov.au or www.smartraveller.gov.au for all the countries you intend to visit. Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary.
TICKETS/ VOUCHERS
12.1 Tickets/ vouchers are valid for a period of 12 months from the date of issue, this excludes tickets that have been booked for a specified date or where a 'valid to' date is specified.
COUPON CODES
13.1 The use of our coupon codes are limited to ONE use per code per customer account. Repeated abuse of these offers by purchasing individual items instead of a single purchase is a breach of our terms and may lead to legal action. By purchasing from us, you agree to limit your use to a one-time-only proposition.
13.2 Any promotion offered is subject to it’s own T & C’s which will be visible at the time of promo code given. These will be such things as, but not limited to: minimum spend, certain products, valid for returning customers only. Coupon validity right to use will be determined by owner and can be withdrawn at anytime for any reason without explanation.
